TERMS AND CONDITIONS OF SALE
These terms and conditions of sale constitute a binding contract between Customer and ETI. Customer accepts these terms and conditions of sale by making a purchase, placing an order or otherwise shopping on ETI’s website. These terms and conditions of sale are subject to change without prior notice, except that the terms and conditions of sale posted on the Site at the time Customer initially places or modifies an order will govern the order in question.
CHOICE OF LAW
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to Conflicts of Laws Rules, any Arbitration, Enforcement of An Arbitration of Litigation will be brought in Broward County, Florida, and customer consents to the jurisdiction of the Federal and State Courts located in Broward County, Florida, and submits to the jurisdiction thereof and waives the right to change venue. Customer further consents to the exercise of personal jurisdiction by any such court with respect to any such proceeding.
The invalidity of any one or more of the words, phrases, sentences, clauses, sections, or subsections contained in the Agreement shall no affect the enforceability of the remaining portion of this Agreement of any part hereof.
ENTIRETY OF THE AGREEMENT
The terms and conditions of sale from ETI shall be governed and is made subject to the terms contained herein. This Agreement constitutes the entire Agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, both written and oral, among the parties hereto with respect to such subject matter.
MODIFICATION
This Agreement may not be amended or modified except by a written instrument executed by the party against whom enforcement is sought, provided that ETI may, at its sole discretion, revise this Agreement from time to time without notice to Customer by posting the revised Agreement terms on this web site. Any additional terms in any forms delivered by Customer are hereby deemed to be material alterations and notice of objection to them and rejection to them is hereby given. Prices and availability are subject to change without notice.
WARRANTIES
PRODUCTS PURCHASED BY CUSTOMER FROM ETI ARE MANUFACTURED, PRODUCED OR PROVIDED BY THIRD PARTIES, AND ARE PROVIDED ON AN “AS IS’ BASIS AND ETI MAKES NO WARRANTY WITH RESPECT TO THESE PRODUCTS. Customer acknowledges that ETI is not the manufacture of any products purchased by Customer hereunder and the only warranties offered are those of the respective manufacturer, not ETI. In purchasing the products, Customer is relying on the manufacturer’s specifications only and is not relying on any statements, specifications in any literature, photographs, or other illustrations representing the products that may be provided by ETI. ETI obtains data directly from the manufacturer or distributor of certain products. While ETI makes every effort to ensure the accuracy of this date, this website could include typographical errors and/or technical inaccuracies. ETI reserves the right to modify such date at any time.
ETI hereby expressly disclaims all warranties either express or implied, related to products sold by third parties or affiliates of ETI, including, without limitation, any warranty of merchantability or fitness for a particular purpose. This disclaimer does not affect the terms of the manufacturer’s warranty if any.
LIMITATION OF LIABILITY
ETI will not be liable for lost profits, loss of business or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. ETI will not be liable for products not being available for use or for lost or corrupted date or software or the provision of services by third parties. Customer agrees that for any liability related to the purchase of products provided directly by ETI, ETI is not responsible for any amount of damages exceeding the dollar amount paid by Customer for the product(s) giving rise to the claim.
ETI will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, general insurrection, acts of God or acts of any government agency.
RETURN POILICIES
If you are having problems with the installation of the product purchased, or have any technical questions regarding your purchase, please contact the respective manufacturer’s customer support center.
Defective products must be returned to the respective manufacturer. Software may be returned within 10 (10) calendar days if they are unopened. Opened software is not returnable to ETI. No returns will be accepted without prior authorization form ETI. No returns will be accepted beyond the indicated return period.
Customer is responsible for all shipping charges. All returns must be 100% complete, contain all original boxes and packing material, have original UPC codes on the manufacturer’s boxes, and contain all blank warranty cards, accessories and documentation provided by the manufacturer. In complete returns may be returned to sender or subject to a restocking fee of 15% or more, depending on the condition or the return.
